These Terms of Service (“Terms”) govern your access to and use of Beacon, including our website, application, chatbot features, wellness-support tools, educational resources, AI-supported features, and related services (collectively, the “Service”). The Service is provided by Invent Yourself, LLC (“Company,” “we,” “us,” or “our”).
By creating an account, accessing, or using Beacon, you agree to these Terms. If you do not agree to these Terms, do not use the Service.
Beacon is an AI-supported personal wellness tool designed to help adults pause, reflect, explore thoughts and emotions, identify patterns, consider values, and think through possible next steps.
Beacon may use concepts, exercises, reflection techniques, and educational approaches informed by Acceptance and Commitment Therapy (“ACT”), Cognitive Behavioral Therapy (“CBT”), and other general wellness principles.
Beacon is intended to support personal reflection, education, and general wellness. It is not intended to provide psychotherapy, mental health treatment, diagnosis, clinical assessment, or individualized professional care.
The use of ACT-informed, CBT-informed, or other psychology-related concepts within Beacon does not mean that therapy or a professional therapeutic relationship is being provided.
Beacon is intended only for adults.
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, to create an account or use the Service.
Beacon is not designed or intended for use by children or minors.
By creating an account or using Beacon, you represent that you meet these eligibility requirements.
Beacon is not a therapist, psychologist, psychiatrist, counselor, physician, social worker, medical provider, crisis counselor, or other licensed healthcare or mental health professional.
Beacon does not provide:
Beacon should not be used to diagnose, treat, cure, prevent, or manage a mental health condition, medical condition, or other health condition.
If you have questions about your mental health, physical health, diagnosis, medication, treatment, or individualized care, consult an appropriately qualified professional.
Beacon may provide prompts, exercises, explanations, or reflections informed by concepts commonly used within Acceptance and Commitment Therapy (“ACT”) and Cognitive Behavioral Therapy (“CBT”).
These may include concepts related to thoughts, emotions, values, behaviors, acceptance, perspective, reflection, coping, habits, or personal decision-making.
The inclusion of these concepts is educational and supportive only.
Beacon does not perform ACT, CBT, psychotherapy, counseling, or any other form of licensed mental health treatment.
An interaction with Beacon does not create a therapist-client, psychologist-patient, physician-patient, counselor-client, or other professional healthcare relationship between you and Invent Yourself, LLC, Beacon, or any person associated with the Service.
You should not interpret Beacon's use of therapeutic concepts, terminology, or exercises as a representation that you are receiving therapy or professional mental health treatment.
Beacon is not a crisis-response or emergency service.
Do not rely on Beacon if you or another person is experiencing an emergency, immediate danger, an immediate risk of self-harm, an immediate risk of harming someone else, a medical emergency, abuse, violence, or another urgent safety situation.
In an emergency or immediate safety situation, contact local emergency services or an appropriate qualified crisis or healthcare provider.
Beacon does not monitor users in real time and should never be relied upon to identify, prevent, report, respond to, or resolve an emergency.
You remain responsible for seeking appropriate human assistance when circumstances require immediate, professional, medical, mental health, or emergency support.
Beacon is designed to allow users to discuss general personal experiences, emotions, thoughts, stressors, goals, values, habits, relationships, and wellness-related concerns.
However, Beacon should not be used as a medical record, patient portal, clinical recordkeeping system, therapy record, treatment-management system, or repository for sensitive healthcare documents.
Do not submit information that Beacon does not need in order to provide general wellness support, including:
Users should share only the information reasonably necessary for the wellness-support interaction they choose to have with Beacon.
Beacon is not currently offered as a HIPAA-supported product or service, and we do not currently enter into Business Associate Agreements (“BAAs”) for Beacon.
Beacon is not intended to function as an electronic health record, clinical documentation system, patient-management platform, or other system for healthcare providers to create, receive, maintain, or transmit protected health information on behalf of patients.
Healthcare providers, covered entities, business associates, employers, organizations, and other regulated users are responsible for determining whether their use of Beacon is permitted under their own legal, privacy, professional, contractual, and organizational obligations.
If your intended use requires HIPAA compliance, a BAA, clinical documentation, patient records, or professional treatment records, do not use Beacon for that purpose.
Beacon uses artificial intelligence, including large language models and related technologies, to generate responses based on user-submitted messages, selections, conversation context, system instructions, wellness-support materials, and related information.
You understand that you are interacting with an AI-supported system rather than a human therapist, counselor, medical provider, or other professional.
Beacon's responses are machine-generated and probabilistic. Similar inputs may produce different responses, and Beacon may misunderstand the meaning, circumstances, severity, or context of information you provide.
Beacon output requires human judgment.
Artificial intelligence can make mistakes.
Beacon-generated responses may be inaccurate, incomplete, inappropriate, inconsistent, outdated, biased, unsuitable, or unhelpful for a particular person or situation.
We do not guarantee that any Beacon response will be accurate, complete, effective, safe, appropriate, or suitable for your particular circumstances.
Beacon may also fail to recognize important details, misunderstand context, or provide a response that does not appropriately reflect the seriousness of a situation.
You are responsible for reviewing and deciding whether any Beacon-generated information is appropriate for you.
Do not rely on Beacon as the sole basis for important decisions involving your mental health, physical health, personal safety, medication, treatment, finances, legal rights, employment, relationships, or other significant matters.
When professional judgment is appropriate, consult a qualified professional.
You are responsible for your use of Beacon and for decisions you make based on information provided through the Service.
Beacon is intended to support reflection—not replace your judgment.
You agree not to rely on Beacon as the sole basis for decisions involving:
If a Beacon response does not seem appropriate, safe, accurate, or helpful, you should disregard it and seek other appropriate support.
Subject to these Terms, you may use Beacon-generated outputs for your own personal, educational, or internal purposes.
Beacon does not guarantee that AI-generated outputs are unique. Because of the nature of artificial intelligence systems, identical or similar outputs may be generated for other users.
We make no representation that AI-generated outputs are copyrightable, protectable, exclusive, or free from third-party rights.
You are responsible for reviewing and modifying Beacon outputs before relying on them, sharing them, publishing them, or using them in another context.
You may not represent Beacon-generated content as:
You retain any rights you have in content that you submit to Beacon.
By submitting content, you grant Invent Yourself, LLC a limited right to process that content as reasonably necessary to provide, maintain, secure, troubleshoot, monitor, and improve the Service, subject to our Privacy Policy and applicable law.
You represent that you have the right to submit any content you provide and that your content does not violate these Terms, applicable law, or the rights of another person.
Do not submit confidential, identifying, medical, financial, or other sensitive information belonging to another person without appropriate authorization.
Beacon may rely on third-party service providers to operate, secure, host, deliver, maintain, and improve the Service.
These providers may include artificial intelligence providers, cloud infrastructure providers, database providers, authentication providers, payment processors, analytics providers, security providers, domain registrars, website hosting providers, and similar service providers.
Third-party providers may process information as necessary to perform services for Beacon.
For example, Beacon may use third-party artificial intelligence providers to generate responses, cloud providers to operate application infrastructure, authentication providers to manage account access, database providers to store application information, and payment processors to handle subscriptions or payments.
Third-party providers may be added, removed, or replaced over time as the Service evolves.
Beacon does not control every aspect of third-party artificial intelligence systems, including how those systems generate particular responses or whether similar outputs may be generated for other users.
More information about categories of service providers, information processing, and data practices is provided in our Privacy Policy.
Information submitted to Beacon may be processed as necessary to provide the Service, maintain accounts, generate responses, operate features, secure the platform, investigate technical problems, enforce these Terms, and support the operation and improvement of Beacon.
We may use aggregated, de-identified, or anonymized information to understand usage patterns, maintain the Service, improve functionality, troubleshoot problems, monitor security, and develop improvements, subject to our Privacy Policy and applicable law.
Our Privacy Policy provides additional information regarding the information we collect, why we collect it, how it may be processed, how long it may be retained, and the service providers that may process information on our behalf.
Your use of Beacon is also governed by our Privacy Policy.
The Privacy Policy explains the types of information we may collect, how information is used, how service providers may process information, our retention practices, security practices, and choices that may be available to users.
You should review the Privacy Policy before using Beacon.
Because Beacon is intended for personal wellness conversations, you should consider the sensitivity of information before submitting it and provide only information reasonably necessary for the interaction.
You agree not to use Beacon to:
We may restrict, suspend, or terminate access if we reasonably believe a user has violated these Terms or is using Beacon in an unlawful, unsafe, abusive, fraudulent, or inappropriate manner.
You may need an account to access Beacon.
You agree to provide accurate information when creating or maintaining your account and to keep your login credentials confidential and secure.
You are responsible for activity occurring through your account.
You may not share credentials in a manner that bypasses applicable user, subscription, or licensing limits.
Notify us promptly if you believe your account has been accessed or compromised without authorization.
We may suspend, restrict, disable, or terminate accounts because of misuse, security concerns, nonpayment, suspected fraud, or violation of these Terms.
Some users may receive access to Beacon through an employer, organization, community group, agency, subscription group, pilot program, access code, or other sponsoring organization.
If you access Beacon through an organization, your use may also be subject to that organization's policies, eligibility requirements, subscription limits, or account-management procedures.
An organization may control whether you remain eligible to access Beacon under its subscription or program.
Unless otherwise disclosed in our Privacy Policy or an applicable agreement, organization-sponsored access does not transform Beacon into professional mental health treatment, employee assistance counseling, clinical care, or a healthcare service.
Organizations are responsible for determining whether offering Beacon to their users is appropriate under their own legal, employment, professional, contractual, and privacy obligations.
Some Beacon features or access plans may require payment or a subscription.
Payments may be processed by a third-party payment provider such as Stripe.
By purchasing a subscription, you authorize us and our payment processor to charge applicable fees, taxes, and recurring subscription amounts according to the plan you select.
Subscription terms, pricing, renewal dates, cancellation procedures, and applicable refund policies may be displayed at checkout, in your account, or in an applicable written agreement.
Unless otherwise stated:
Deleting a Beacon account does not necessarily cancel a separately maintained paid subscription. You are responsible for canceling an active subscription through the applicable billing process if you wish to prevent future renewal charges.
Beacon, including its software, design, branding, content, workflows, prompts, interfaces, documentation, graphics, logos, and related materials, is owned by Invent Yourself, LLC or its licensors and is protected by applicable intellectual property laws.
You may use Beacon only as permitted by these Terms.
Except where expressly permitted by us in writing, you may not copy, reproduce, distribute, sell, license, lease, modify, reverse engineer, create derivative works from, or commercially exploit Beacon or its proprietary materials.
Nothing in these Terms transfers ownership of Beacon or our intellectual property to you.
If you voluntarily provide suggestions, ideas, comments, recommendations, or other feedback regarding Beacon, you grant us permission to use that feedback to operate, modify, develop, or improve the Service without restriction or compensation to you.
We may modify, update, limit, suspend, replace, or discontinue any part of Beacon at any time.
We may add, remove, or modify features, models, prompts, wellness-support approaches, usage limits, pricing, availability, service providers, or other functionality.
We are not liable for modification, suspension, or discontinuation of the Service except where liability cannot be excluded under applicable law.
Artificial intelligence, consumer privacy, health-data, healthcare, and consumer-protection laws and regulations continue to develop.
We may modify Beacon, these Terms, our Privacy Policy, disclaimers, security practices, or other policies in response to legal, regulatory, safety, technical, security, or operational developments.
If we make material changes to these Terms, we may provide notice through email, an in-app message, a website notice, or another reasonable method.
Continued use of Beacon after updated Terms become effective constitutes acceptance of the updated Terms.
If you do not agree with updated Terms, you should stop using Beacon and cancel any applicable subscription.
You may stop using Beacon at any time.
We may suspend, restrict, or terminate your access to Beacon if:
Certain provisions of these Terms survive termination, including provisions relating to intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, and dispute resolution.
Beacon is provided “as is” and “as available.”
To the fullest extent permitted by applicable law, Invent Yourself, LLC disclaims all warranties, express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, security, effectiveness, or suitability for any particular personal, mental health, medical, clinical, or professional purpose.
We do not guarantee that Beacon will be uninterrupted, error-free, completely secure, accurate, complete, effective, or appropriate for a particular user or situation.
We do not guarantee that using Beacon will improve wellness, mental health, relationships, stress, mood, behavior, decision-making, or any other personal outcome.
To the fullest extent permitted by applicable law, Invent Yourself, LLC and its owners, officers, employees, contractors, partners, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages arising from or relating to Beacon.
This includes, to the extent permitted by law, damages involving lost profits, lost revenue, lost data, loss of goodwill, personal injury, emotional distress, reliance on AI-generated content, interruption of service, or decisions made based on Beacon output.
To the fullest extent permitted by applicable law, our total liability for any claim related to Beacon will not exceed the greater of:
(a) the amount you paid directly to us for Beacon during the twelve (12) months before the event giving rise to the claim; or
(b) one hundred dollars ($100).
Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded.
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Invent Yourself, LLC, its owners, officers, employees, contractors, partners, licensors, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.
Except where these Terms require arbitration or applicable law requires otherwise, venue and jurisdiction for disputes will be located in the applicable state or federal courts located in Crawford County, Missouri.
Please read this section carefully. It may affect your legal rights, including your ability to file a lawsuit in court, have a jury trial, or participate in a class action.
Before filing a lawsuit, arbitration demand, or other formal proceeding, you and Invent Yourself, LLC agree to first make a good-faith effort to resolve the dispute informally.
The party raising the dispute must provide written notice describing the dispute, the requested resolution, and contact information for follow-up.
Notices regarding Beacon should be sent to:
After notice is received, the parties will make a good-faith effort to resolve the dispute for at least thirty (30) days before beginning arbitration or a court proceeding, unless immediate injunctive relief is reasonably necessary.
Either party may bring an individual claim in small claims court if the claim qualifies for and remains within that court's jurisdiction.
A qualifying small-claims action may proceed instead of arbitration.
Except for disputes eligible for small claims court or the exceptions identified below, you and Invent Yourself, LLC agree that disputes, claims, or controversies arising from or relating to these Terms, Beacon, your account, billing, privacy, data, AI-generated output, communications concerning Beacon, or your use of the Service will be resolved through final and binding individual arbitration rather than in court.
Arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules and Mediation Procedures unless the parties agree to another provider or applicable law requires otherwise.
If AAA is unavailable or declines to administer a dispute, the parties will attempt in good faith to select a comparable arbitration provider. If the parties cannot agree, a court of competent jurisdiction may appoint an arbitration provider or arbitrator where permitted by law.
Arbitration may occur through video conference, telephone, written submissions, or an in-person hearing as permitted by applicable arbitration rules and determined by the arbitrator.
The arbitrator will have authority to resolve the individual dispute and award individual relief available under applicable law.
The arbitrator may award the same individual damages and individual relief that a court could award, but only in favor of the individual party seeking relief and only as necessary to resolve that person's claim.
Arbitration fees and administrative costs will be handled according to the applicable arbitration provider's consumer rules, fee schedules, and applicable law.
Each party is responsible for its own attorney's fees and costs unless applicable law, the arbitration rules, the arbitrator, or these Terms provide otherwise.
To the fullest extent permitted by applicable law, you and Invent Yourself, LLC agree that disputes will be resolved only on an individual basis.
You may not bring a claim as a plaintiff or class member in a class action, collective action, consolidated action, private attorney general action, or other representative proceeding.
An arbitrator may not consolidate claims involving multiple users or preside over a class, collective, consolidated, private attorney general, or representative proceeding unless Invent Yourself, LLC expressly agrees in writing after the dispute arises or applicable law requires otherwise.
If twenty-five (25) or more substantially similar arbitration demands are filed against Invent Yourself, LLC concerning Beacon by or with the assistance of the same law firm, organization, group of law firms, coordinated representatives, or related groups, the parties agree that the arbitration provider's applicable mass-arbitration procedures or rules may apply.
The parties agree to work in good faith with the arbitration provider regarding appropriate administration, scheduling, batching, bellwether procedures, mediation, filing procedures, and fees.
Either party may bring the following types of claims in court when permitted by applicable law:
For disputes that lawfully proceed in court rather than arbitration, you and Invent Yourself, LLC waive the right to a jury trial to the fullest extent permitted by applicable law.
For a dispute not subject to arbitration or small claims court, the parties agree to the exclusive jurisdiction and venue of the Circuit Court of Crawford County, Missouri, or, when federal jurisdiction exists, the United States District Court for the Eastern District of Missouri, unless applicable law requires a different jurisdiction or venue.
You may opt out of the arbitration agreement and class-action waiver contained in this Section by sending written notice to Invent Yourself, LLC within thirty (30) days after you first accept these Terms.
The notice must include your name, the email address associated with your Beacon account, and a clear statement that you are opting out of the arbitration agreement.
Opting out of arbitration will not affect the remaining provisions of these Terms.
If any provision of this Dispute Resolution section is determined to be unenforceable, that provision will be severed to the extent permitted by applicable law and the remaining provisions will remain in effect.
If the class-action waiver is determined to be unenforceable with respect to a particular claim or request for relief, that claim or request for relief will proceed in court rather than arbitration unless the parties agree otherwise.
This Dispute Resolution section survives termination of your Beacon account, expiration or cancellation of a subscription, and discontinuation of the Service.
We may update these Terms from time to time.
If we make material changes, we may provide notice by posting the revised Terms, sending an email, providing an in-app notice, or using another reasonable method.
The updated Terms will become effective on the date specified in the revised Terms or notice.
Your continued use of Beacon after updated Terms become effective means that you accept the updated Terms.
If you do not agree to the revised Terms, you should stop using Beacon.
